The following aircraft operating on non-commercial flights are required under European law to operate under EASA Air Operations Regulation (EU) No 965/2012 (known as “Part-NCC”).
- Any complex aircraft which is registered in an EASA member state or
- Any complex aircraft which is registered in a non-EASA state but primarily based in an EASA member state or operated by an operator established in an EASA member state.
An aircraft is deemed to be complex if it falls under one of the following categories:
- An aeroplane:
- with a maximum certificated take-off mass exceeding 5700 kg, or
- certificated for a maximum passenger seating configuration of more than nineteen, or
- certificated for operation with a minimum crew of at least two pilots, or
- equipped with (a) turbojet engine(s) or more than one turboprop engine.
- A helicopter certificated:
- for a maximum take-off mass exceeding 3175 kg, or
- for a maximum passenger seating configuration of more than nine, or
- for operation with a minimum crew of at least two pilots.
- A tilt rotor aircraft
The operator of an aircraft is typically any person or organisation that looks after the operation of a privately owned aircraft.
Part-NCC requires the operator of a qualifying aircraft to effectively follow the same essential requirements as a commercial air transport operator.
To achieve Part-NCC compliance for a qualifying aircraft the operator will submit a declaration to the relevant competent authority in the EASA member state where the aircraft is registered or in the case of a non-EASA registered aircraft to the EASA member state where the operator is based.
The declaration will detail the aircraft type, their operational and continuing airworthiness arrangements, any approvals held etc.
A qualifying aircraft under Part-NCC will need:
- Operations, Compliance Monitoring and Safety Management Manuals
- Lines of Responsibility for overall accountability, safety and compliance
- A declaration of compliance to the relevant competent authority
