French Social Security Changes for Yacht Crew - Social Security Financing Act for 2015 - 12 September 2017 update from ENIM

The French newspaper Nice Matin has used the start of the Cannes Yachting Festival to announce the end of the Social Security Finance Act and specifically of ‘Décret no 2017-307′ which passed into French law in March, 2017. A link to the article can be found here:

Unfortunately this announcement appears to be somewhat premature as ENIM have today released updated guidance on the application of the decree that appears to be even wider in scope than previously anticipated with the inclusion of private yachts where previously the decree had been understood to apply only to commercial charter yachts.

Discussions are ongoing at governmental level with regard to the scope and application of the decree.

This is amidst continued lobbying from the yachting industry for urgent changes to be made to the legislation in an effort to reverse the significant damage already incurred by the French nautical economy as a result of the decree.

It is likely that any changes to the decree will be made in the autumn and to keep updated on the situation Oceanskies will be attending the next fiscal forum taking place on 28th September at the Yacht Club de Monaco whilst we continue our own dialogue with ENIM to ensure that seafarers employed by Oceanskies Crew are in compliance with the decree.
