Malta Flag Social Security Requirements for UK Crew Post Brexit

The Malta Department of Social Security have clarified the social security obligations for UK resident crew working onboard Malta registered yachts following the end of the Brexit transition period on the 31st December, 2020.

In summary:

1. For UK Nationals who are UK Resident

Following the end of the transition period there will no longer be an obligation for Malta social security contributions to be made by employer or seafarer.

2. For EU Nationals who are UK Resident

Following the end of the transition period there will remain an obligation for Malta social security contributions to be made by employer and seafarer.

The rationale behind these changes is that the provisions of the Brexit withdrawal agreement applies only for UK nationals resident in the UK and does not apply to EU national seafarers residing in the UK who will remain covered by EU rules whilst working within EU jurisdiction meaning that an employer and employee must still fulfil their obligations to pay social security contributions in Malta.

Oceanskies Crew is registered as a foreign employer with the Malta Inland Revenue Department and, when applicable, is able to register the yacht crew that it employs onboard Malta registered vessels with the Malta Department of Social Security and arrange for the payment of social security contributions.

Crew members who are registered will be issued with an A1 Certificate (social security cover) and then may be able to apply for an S1 Certificate and/or EHIC card.
