BREXIT: Malta Flag Social Security Requirements for UK Crew Post Brexit - Update

Following the  withdrawal of the United Kingdom (UK) from the European Union (EU), Oceanskies Crew have been provided with the following updated guidance concerning the treatment of Malta Class 1 Social Security Contributions for Yacht Crew who are resident in or nationals of the UK from the Department of Social Security in Malta:

- UK residents/nationals who will commence their employment on board a Maltese flagged vessel as from 1st January 2021, shall be subject to pay social security contributions in Malta by virtue of the Agreement reached between UK and the European Union.

- UK residents/nationals who commenced their employment prior to 31st December 2020, as per the Withdrawal Agreement, the provisions of EU Regulation 883/2004 shall continue to apply for them and therefore by virtue of Article 11.4 of EU Regulation 883/2004 they are subject to continue paying social security contributions in Malta whilst working on board a Maltese flagged vessel as from 1st of January 2021.

Oceanskies Crew is the yacht crew employment and payroll division of Oceanskies which is registered as a foreign employer with the Malta Inland Revenue Department and, as such, is able to register the yacht crew that it employs with the Malta Department of Social Security and arrange for the payment of social security contributions.

Crew members who are registered will be issued with an A1 Certificate (social security cover) and then may be able to apply for an S1 Certificate and/or EHIC card.
