Key requirements for chartering your yacht

To make your yacht legally available for charter, the following conditions must be met:

  • The yacht must be commercially registered
  • The yacht must be in “free circulation”
  • The owning company must be VAT registered in every country where the yacht is offered for charter
  • The owning company and yacht must comply with all applicable local regulations, including the need for charter licences where required
  • All guest usage must take place under a formal charter agreement

There is no single “best” flag for chartering; the optimal choice depends on your yacht’s intended operations and cruising areas.

  • Charter licence eligibility
  • Regulatory requirements such as minimum safe manning
  • Operational considerations specific to the chosen flag

A word of caution - VAT and chartering

Some yacht owners view chartering as a way to achieve VAT efficiencies. However, authorities are increasingly alert to arrangements that are designed primarily for VAT advantages without genuine commercial activity.

The United Kingdom’s HMRC has highlighted a number of factors that may indicate an abusive structure, including (but not limited to):

  • The primary user of the yacht is also the ultimate owner of the chartering entity
  • The yacht’s purchase was funded (directly or indirectly) by the main user
  • The owner makes prolonged use of the yacht during peak charter seasons
  • Chartering activity is insufficient in continuity or substance to constitute a genuine business
  • The chartering entity records ongoing financial losses
  • Charter fees are settled on paper only (e.g., offset against loans)
  • Fees are set below market value
  • Lease or charter terms deviate significantly from normal commercial practices

If challenged, such structures may be deemed abusive and could result in penalties, fines or more severe punishment.
