Oceanskies have been continuing its dialogue with ENIM on the subject of the implementation of ‘Décret no 2017-307′ which passed into French law in March, 2017.

Following a seminar concerning the implementation of the decree held in Monaco earlier this year we published a blog on our website setting out its scope and implications for yacht crew holding a regular and stable residence in France and embarked on a vessel flying any flag.

The new decree required yacht crew with this status to be enrolled under the French social security regime or under the social security regime of another EU state or a country that has entered into a reciprocal agreement for social security with France from the 1st July 2017 under the provisions of the French Social Security Financing Act for 2015.

On 30 June 2017 ENIM published new guidelines on the scope and procedures for the application of the decree as follows:

“Les marins résidant en France embarqués sous pavillon étranger Domaine(s) :

· Employeur

Vous êtes employeur et vous souhaitez engager un marin ou gens de mer résidant en France sur un navire battant pavillon étranger ? Vous devez lui garantir une protection sociale et l’affilier à l’Enim.

Etes-vous concerné ?

Si vous employez un marin ou gens de mer professionnel:

1 résidant de façon stable et régulière sur le territoire français, dans les départements d’outre-mer et dans les collectivités de Saint-Barthélemy, Saint-Martin et Saint-Pierre-et-Miquelon

2 sur un navire à usage commercial battant pavillon d’un Etat tiers, en dehors de l’Union Européenne, de l’Espace Economie Européen, de la Suisse ou d’un Etat sous convention bilatérale de sécurité sociale avec la France”

The second point clarifies two items, first and most important, it confirms that the Social Security Financing Act 2015 only applies to commercial yachts, in line with the Marine Labour Convention 2006. Secondly we believe that it confirms that yachts registered in Guernsey or Jersey are outside of the scope of the Social Security Financing Act 2015. This is yet to be explicitly confirmed by ENIM.

Below is the separate correspondence received from ENIM in relation to the exemption of private yachts:

“dès lors qu’un navire de plaisance est utilisé à titre privé, on ne fait pas application de l’article 31. Cette appréciation du caractère privé doit être faite en lien avec le statut fiscal du navire.
L’article II – 4 de la MLC précise que « Sauf disposition contraire expresse, la présente convention s’applique à tous les navires appartenant à des entités publiques ou privées normalement affectés à des activités commerciales, à l’exception des navires affectés à la pêche ou à une activité analogue et des navires de construction traditionnelle tels que les boutres et les jonques. La présente convention ne s’applique ni aux navires de guerre ni aux navires de guerre auxiliaires. »”

The situation as the decree is implemented remains fluid and we are continuing our dialogue with ENIM to ensure that seafarers employed by Oceanskies Crew are in compliance with the new requirements.
